***************************************************************** THE NATIONAL PERFORMANCE REVIEW **** STATUS OF RECOMMENDATIONS **** December 16, 1993 ***************************************************************** Implementation of the National Performance Review's (NPR) recommendations is well underway, and many key NPR initiatives have begun. Although much work remains, there has been important activity on both the executive and legislative fronts. The following is a brief summary of the status of NPR recommendations as well as a listing of other reinvention activities occurring within the Administration and Congress. NPR Recommendations and Actions The NPR has a total of 384 recommendations, encompassing approximately 1,200 individual actions. Approximately 49% of NPR recommendations involve legislative action. 25% of all actions involve legislative activity. ***************************************************************** STATUS OF RECOMMENDATIONS/ACTIONS ***************************************************************** The status of the 1,200 individual NPR action items is as follows: - 1% have been completed; - 60% are under active consideration; - 36% have had no action; and - the status of the remaining 3% has not been reported. Of the 300 action items that require legislative action, 3 have been completed (the wool and mohair program has been eliminated, a Hard Rock Mine Reclamation Fund has been established, and a voluntary leave transfer bank has been established), Approximately 200 items are being drafted or have been introduced as legislation, and 86 are awaiting action. The Administration introduced H.R. 3400, the Government Reform and Savings Act, which passed the House on 22 November 1993, which contained 39 NPR action items after undergoing some amendment in the House -- the bill has gone to the Senate for consideration in early 1994. ***************************************************************** EXECUTIVE ORDERS AND PRESIDENTIAL MEMORANDA ***************************************************************** 16 Presidential directives have been issued over the past 3 months to implement NPR recommendations. They are (in chronological order): ****THE PRESIDENT'S COMMUNITY ENTERPRISE BOARD, PRESIDENTIAL MEMORANDUM, SEPT. 9, 1993.**** Creates a board to coordinate across agencies the various programs to help distressed communities and implement community customers are, develop and post services standards that are to be the best in the business. They must benchmark standards, survey their customers, provide them with alternative choices, and provide them with means for redress. This will go a long way in changing the orientation of agency service delivery. ****STREAMLINING THE BUREAUCRACY, PRESIDENTIAL MEMORANDUM, SEPT. 11, 1993.**** Orders agencies to reduce staff by 252,000 over the next 5 years. The goal is to increase the supervisory ratio from 1:7 to 1:15 and to cut staff offices -- the second guessers -- in half, and empower line managers and employees to achieve customer-oriented results. ****SETTING CUSTOMER SERVICE STANDARDS, EXECUTIVE ORDER 12862, SEPT. 11, 1993.**** Agencies that serve the public are required to define who their customers are, develop and post services standards that are to be the best in the business. They must benchmark standards, survey their customers, provide them with alternative choices, and provide them with means for redress. This will go a long way in changing the orientation of agency service delivery. ****ELIMINATION OF ONE-HALF OF EXECUTIVE BRANCH INTERNAL REGULATIONS, EXECUTIVE ORDER 12861, SEPT. 11, 1993.**** Agencies must reduce half of their internal regulations within three years. This will help streamline the headquarters bureaucracy and empower line managers to focus on results and customers, not compliance with rules. ****PRESIDENT'S FOREIGN INTELLIGENCE ADVISORY BOARD, EXECUTIVE ORDER 12863, SEPT. 13, 1993.**** The President's Intelligence Oversight Board is abolished and its functions merged with the President's Foreign Intelligence Advisory Board. *REGULATORY PLANNING REVIEW, EXECUTIVE ORDER 12866, SEPT. 30, 1993.* This reforms the regulatory review process and encourages agencies to avoid the use of unfunded mandates on state and local governments. It puts the review process more in the public light. ****AGENCY RULEMAKING PROCEDURES, PRESIDENTIAL MEMORANDUM, SEPT 30, 1993.**** This directs agencies to streamline their regulatory development process. This will help reduce the time and resources it takes to issue regulations. ****NEGOTIATED RULEMAKING, PRESIDENTIAL MEMORANDUM, SEPT 30, 1993.**** This directs all agencies to conduct at least one rulemaking effort through the use of negotiated rulemaking. This is intended to encourage all agencies to try out an innovative approach that has worked well and cost less in other agencies. ****REPORT OF REGULATIONS REVIEWED, PRESIDENTIAL MEMORANDUM, SEPT. 30, 1993.**** Requires the head of OMB's Office of Information and Regulatory Review to assess the success of the implementation of E.O. 12866 and to report to the President at the end of six months. ****TRADE PROMOTION COORDINATING COMMITTEE, EXECUTIVE ORDER 12870, SEPT. 30, 1993.**** The committee is charged with coordinating the export promotion and export financing activities of the federal government and to develop a government-wide strategic plan for carrying out such programs. ****IMPLEMENTING MANAGEMENT REFORM IN THE EXECUTIVE BRANCH, PRESIDENTIAL MEMORANDUM, OCT. 1, 1993.**** This directs all agency heads to designate someone as chief operating officer and creates the President's Management Council -- comprised of chief operating officers -- to help lead reinvention efforts across the government. This will serve as the main nerve center for the culture change and overall reform implementation efforts. *LABOR-MANAGEMENT PARTNERSHIPS, EXECUTIVE ORDER 12871, OCT 1,1993.* Creates the National Partnership Council to involve government employees and their union representatives in achieving the goals of the NPR. These partnerships will champion change in federal agencies. ****ENHANCING THE INTERGOVERNMENTAL PARTNERSHIP, EXECUTIVE ORDER 12875, OCT. 26, 1993.**** Agencies are required to avoid creating any mandates of action that are not accompanied by grants to pay for them. In addition, agencies are asked to review their waiver application processes to ensure they can complete actions on requests within 120 days. ****STREAMLINING PROCUREMENT THROUGH ELECTRONIC COMMERCE, PRESIDENTIAL MEMORANDUM, OCT. 26, 1993.**** Encourages the exchange of procurement information, such as invoices, electronically between the federal government and private sector. It also provides small businesses with greater access to federal procurement opportunities and simplifies access via standardized formats, using existing networks where possible. ****ESTABLISHMENT OF THE NATIONAL SCIENCE AND TECHNOLOGY COUNCIL, EXECUTIVE ORDER 12881, NOVEMBER 23, 1993.**** Creates the National Science and Technology Council, composed of federal agencies, to coordinate the government's science and technology policy and budget making process. The assistant to the President for science and technology will chair the council. ***PRESIDENT'S COMMITTEE OF ADVISORS ON SCIENCE AND TECHNOLOGY, EXECUTIVE ORDER 12882, NOVEMBER 23, 1993.**** Creates an advisory committee of 16 nonfederal members to advise the President on science and technology matters. The assistant to the President for science and technology will chair the council. ***************************************************************** NPR-RELATED LEGISLATION ***************************************************************** ****THE GOVERNMENT PERFORMANCE AND RESULTS ACT OF 1993, P.L. 103-62 (AUG. 3, 1993).*** This act requires agencies to develop strategic plans and performance measures. It starts with a series of pilot programs and allows waivers of regulations for some of the pilots. ****THE GOVERNMENT REFORM AND SAVINGS ACT OF 1993 (H.R. 3400), INTRODUCED OCTOBER 26, 1993.**** This bill passed the House on November 22 and would fully implement 39 NPR action items. The bill also contains about $38 billion (CBO estimate) in savings over a 5 year period. ****FEDERAL PERSONNEL RESTRUCTURING ACT, H.R. 3218, S. 1535.**** The President has submitted separations incentives legislation that includes buyout, early retirement, and increased training initiatives. These provisions are intended to ease the streamlining efforts. ****FEDERAL ACQUISITION STREAMLINING ACT OF 1993.**** The President also signaled support for a Senate bill, introduced by Sen. Glenn, et al (S. 1587). Hearings will be scheduled in early 1994. Various pieces of legislation that relate to the NPR have been introduced at the initiative of individual members of Congress: - Amendment to the AID appropriations bill (H.R. 2295): requiring AID to implement all NPR recommendations and to submit legislation for those items requiring congressional action (Rep. Obey). - Amendment to the Treasury, Postal Service appropriations bill (H.R. 2403; P.L. 103-123) to allow the agencies covered by this bill to carry over of 50 percent of any savings in operating costs (Rep. Hoyer). - Senator Byrd has requested that FTE floors be removed from his committee's pending appropriation bills. It has created 5 task forces to address major issues: downsizing, field structures, internal deregulation, performance measures, and electronic commerce. The NATIONAL PARTNERSHIP COUNCIL has met twice; a second meeting was held on December 17. It has created 5 working groups: hiring, classification, performance management, FPM sunsetting, and labor law reform. GOVERNMENT INFORMATION TECHNOLOGY SERVICES working group held its first meeting on December 16. COMMUNITY ENTERPRISE BOARD has meet a number of times. It is preparing legislative proposals to create waivers for states and localities. ********************************************* OFFICE OF MANAGEMENT AND BUDGET ********************************************** ****PAPERWORK REDUCTION ACT CLEARANCE OF VOLUNTARY CUSTOMER SURVEYS****, OMB Memorandum, Sept. 29, 1993. (M-93-14) This moves the clearance for voluntary customers surveys from a centralized office in OMB to each agency. It is intended to help implement the Customer Service Executive Order's requirement to obtain customer input. ****GOVERNMENT PERFORMANCE AND RESULTS ACT****, OMB Memorandum, Oct. 8, 1993. (M-93-2) This memo encourages each agency to designate a pilot program and creates an interagency team to guide implementation. Phil Lader, the former OMB Deputy Director for Management, circulated a draft paper on changing the roles of the Inspectors General and discussed it with them at their monthly meeting on October 5. ************************************************* GENERAL ACCOUNTING OFFICE (GAO) REPORT ON NPR ************************************************** On December 3, 1993, the GAO released "Management Reform: GAO's Comments on the National Performance Review's Recommendations." Of the 384 NPR recommendations, GAO disagreed with only one (DOL- 09, "Create a Boundary Spanning Workforce Development Council). The GAO agreed or generally agreed with 262 recommendations and offered no comment on 121 for which it did not have enough information to make a determination. Of the approximately 1,200 actions in the NPR Reports, agencies report that action is underway for 60% of them. The following is a sample of activities: Agencies have created about 100 reinvention labs to test out the concepts of reinventing government. The labs are a test bed for agency innovations, deregulation, streamlining, and other NPR proposals. Agriculture has moved to close surplus field offices. HUD has announced it will close its regional offices and its state offices will report directly to headquarters. Labor has abolished the use of bi-weekly time and attendance reports for most of its salaried workers. Other agencies are continuing their prior NPR teams and are working on independent reports. State and FEMA have already issued their own NPR reports. Defense and Interior have created their own top-level agency-wide teams to implement the report. Half-dozen agency heads are preparing to sign performance agreements with the President in the near future. These agreements will help create a more results-oriented environment and a clear sense of priorities. NASA, GSA, OPM, and Customs have testified before Congress on their progress; in total, Congress has held more than 32 hearings on NPR proposals and agency actions. AID is cutting back its missions in 20 countries which are sufficiently developed, or which are chronically incapable of managing aid, or who act against U.S. interests. GSA imposed the first phase of a building construction freeze on November 23, 1993, for more than 200 projects. ****************************************** NPR Actions and Alumni Status ******************************************* A conference on customer service for those in agencies responsible for implementing the Executive Order was held November 9th for executive-level managers. December 13-15, a second conference was held for operational level staff. NetResults News: NetResults has evolved considerably since September 7. Registrants have grown to over 800. The array of NPR implementation information, documents, and archives on NetResults is diversified and expected grow with the issuance of the monographs. Access to NPR information, documents, and archives includes e-mail (either x.400, Internet, Prodigy, CompuServe, GEnie, or America Online) as well as a growing number of Internet hosts (CapAccess, MetaNet, Library of Congress, USDA Extension Service, and the FQI Bulletin Board). Finally, several networks within NetResults are now underway: People Net, MeasureNet, Budget Net, and the Grant Network. The Department of the Interior sponsored a government-wide workshop on how to reduce internal agency regulations. A conference on Reinvention Labs, cosponsored with GSA, was held on October 25-27. NPR Project Director Bob Stone was appointed to the board of directors for the proposed Air Traffic Control corporation.
